Terms of Service
Introduction and Acceptance of Terms
This Terms of Service (“Terms”) is a legal agreement between you (referred to as “User” or “you”) and BCD Motors (“BCD Motors,” “the Company,” “we,” or “us”). These Terms govern your access to and use of BCD Motors’ chauffeured ride-hailing service (“VTC service” or “Service”).
By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not use the Service. These Terms should be read in conjunction with our Privacy Policy, which is hereby incorporated by reference. By agreeing to these Terms, you also agree to the terms of our Privacy Policy.
Our VTC service connects riders (passengers seeking transportation) with professional drivers. Unless otherwise specified, the terms and conditions in this document apply to all users of the Service, including both riders and drivers. Additional requirements may apply to drivers as described in the “Driver Responsibilities and Conduct” section below.
Eligibility and Account Use
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service. By using the BCD Motors VTC service, you represent and warrant that you are of legal age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of another person or a legal entity, you also represent that you have the authority to bind that person or entity to these Terms.
When creating an account with BCD Motors, you agree to provide accurate, current, and complete information about yourself as prompted by the registration process. You further agree to promptly update such information to keep it accurate and complete. You may not impersonate anyone or create an account for someone else without permission. BCD Motors reserves the right to decline registration or to suspend/terminate your account if information provided is false, violates someone else’s rights, or we suspect fraudulent activity.
You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You must not share your account with anyone else or allow others to access the Service using your credentials. If you suspect any unauthorized use of your account or a security breach, you must notify us immediately. We will not be liable for any loss or damage arising from your failure to keep your account secure.
We reserve the right to suspend or terminate your user account at any time, at our discretion, if we believe that you have violated these Terms, provided false information, or engaged in fraudulent or harmful behavior. In such cases, we may also take legal action or cooperate with law enforcement as appropriate.
Booking Process and Responsibilities
To request a ride, you must use the BCD Motors mobile application or website and provide the required information (such as your pickup location, destination, and desired pickup time). Once you submit a ride request, BCD Motors will attempt to match you with an available driver. Please note: we do not guarantee that a driver will be available for every request. A booking is only confirmed when a driver accepts your ride request, at which point you will receive a confirmation in the app (including details like the driver’s name, vehicle, and estimated arrival time).
You are responsible for being at the designated pickup location at the scheduled pickup time. Please ensure the contact information in your account is up to date, as drivers may need to contact you by phone or through the app. If you are not present at the pickup location, or if you cannot be reached, the driver may cancel the ride and depart. In such cases, you may be charged a no-show or late cancellation fee (as outlined in our cancellation policy).
If you need to cancel or modify a booking, you should do so as soon as possible through the app. Cancelling a ride after a driver has been assigned or is en route may result in a cancellation fee (see the Pricing, Payment, and Cancellation Policy section below for details). Similarly, if you fail to show up for a scheduled ride, you may be charged a no-show fee. BCD Motors and its drivers reserve the right to cancel a booking at their discretion. For example, a ride may be canceled if no driver is available, if the driver cannot locate you at pickup, if you are more than a certain number of minutes late, or if fulfilling the ride would pose a safety risk or violate any law. If BCD Motors or the driver cancels your ride, you will not be charged for the ride and (if applicable) any amounts paid will be refunded to your payment method.
Pricing, Payment, and Cancellation Policy
Pricing: The price for each ride is determined based on various factors such as distance, expected travel time, vehicle type, and demand. Before you confirm a booking, the app will display the fare estimate or a quoted price for that ride. All prices are listed in the local currency and include applicable taxes and surcharges unless stated otherwise. Additional charges (such as road tolls, airport fees, or surcharges for high-demand periods) will be disclosed to you before or during the booking when possible.
Payment: You must have a valid payment method (e.g., a credit or debit card) linked to your BCD Motors account. By confirming a ride booking, you authorize BCD Motors (or its designated payment processor) to charge the quoted fare and any applicable fees to your payment method. Payment is typically processed automatically at the end of your ride (or at the time of booking for certain services). If any payment is declined or fails, you agree to promptly provide a new valid payment method, and we reserve the right to suspend your access to the Service until payment issues are resolved. All payment processing is handled securely, and we do not store full payment card details on our own servers.
Cancellation by You: You may cancel a ride request at any time via the app before the driver arrives. However, if you cancel after a driver has already accepted your request and is on the way, or if you cancel close to the scheduled pickup time, you may be charged a cancellation fee. Similarly, if you are not at the pickup location or unreachable when the driver arrives (a “no-show”), the driver may cancel the ride and you may be charged a no-show fee. These fees compensate drivers for their time and effort; the specific amount of the fee may depend on factors like how much time passed between the driver accepting your request and the cancellation. The app will notify you if a cancellation or no-show fee is charged.
Cancellation by Driver or Company: In some cases, a driver might cancel a ride (for example, if they have an emergency or cannot find you at pickup) or BCD Motors might need to cancel a booking (for example, due to a technical problem or safety concern). If your ride is canceled by the driver or by us, you will not be charged for the ride. If you had pre-paid or a hold was placed on your card, you will receive a full refund or the hold will be released. We will do our best to inform you as soon as possible if a cancellation occurs and, if feasible, help you arrange an alternative ride. However, BCD Motors is not liable for any inconvenience or loss you may incur due to a driver or company cancellation.
Additional Charges: In certain situations, additional fees may apply to your ride. For instance, if the driver has to wait for you beyond a reasonable grace period, if you request extra stops or a significantly longer route than originally booked, or if the ride incurs tolls, parking fees, or other out-of-pocket expenses, these costs may be added to your fare. If during the ride you or your passengers cause any damage or mess that requires cleaning (e.g., spilling food or drink, or vomiting in the vehicle), you may be charged a cleaning or damage fee as determined by BCD Motors and the driver. BCD Motors will provide notice of any such additional charges, and by using the Service you agree to pay for these extra costs when applicable.
User Conduct and Obligations
As a user of the VTC service, you agree to the following rules of conduct. These obligations are in place to ensure a safe and pleasant experience for both riders and drivers:
- Use the Service only for lawful purposes and refrain from any illegal, violent, or harmful activity.
- Treat drivers and other users with respect and courtesy. Harassment, abusive language, and discrimination (on the basis of race, religion, gender, disability, or any other characteristic) are strictly prohibited.
- Follow all applicable safety and traffic laws during your ride (for example, you and all passengers must wear seat belts, and you must not encourage or request the driver to exceed the speed limit or break any laws).
- Do not smoke, vape, or consume illegal substances in the vehicle. You must also adhere to local laws regarding alcohol (e.g., no open container of alcohol if prohibited). Drivers have the right to refuse or end a ride if a passenger is excessively intoxicated, aggressive, or poses a safety risk.
- Do not damage, deface, or litter in the vehicle. You will be held responsible for any damage to the car’s interior or exterior that you cause, as well as for any necessary cleaning due to spills, vomiting, or other messes beyond ordinary wear and tear.
- Do not carry weapons, illegal drugs, or hazardous materials into the vehicle. Drivers have the right to refuse or terminate a trip if they suspect illegal or dangerous activities. If a ride is terminated due to your misconduct, you may be charged the full fare and any applicable fees, and your behavior may be reported to law enforcement.
Violation of any of the above rules may result in the immediate termination of your ride, and/or suspension or termination of your BCD Motors account. BCD Motors reserves the right to investigate and take appropriate legal action against users who engage in prohibited behaviors, which may include reporting incidents to the authorities or seeking compensation for any losses or damages.
Driver Responsibilities and Conduct
If you are a driver authorized to provide transportation services via the BCD Motors platform, you agree to the following additional terms and standards of conduct:
- Hold and maintain all licenses, permits, and approvals necessary to operate as a professional driver in your jurisdiction. This includes a valid driver’s license appropriate for your vehicle, any required chauffeur or VTC permits, and compliance with local regulations for ride-hailing or transportation services.
- Maintain appropriate insurance coverage as required by law and by BCD Motors’ policies. You must carry at least the minimum auto liability insurance for a commercial or ride-hailing driver. You may be required to provide proof of such insurance to BCD Motors, and you agree to notify us immediately of any changes to your insurance status.
- Keep your vehicle in safe, reliable, and clean condition. Your vehicle must meet BCD Motors’ quality standards and all legal safety requirements (including any required inspections). You are responsible for all maintenance, repairs, and cleanliness of your vehicle to ensure riders have a safe and comfortable experience.
- Drive safely and obey all traffic laws at all times; do not drive under the influence of alcohol or drugs, and avoid distracted driving (for example, texting or using the app while the vehicle is in motion, except in hands-free mode as allowed by law).
- Provide professional and courteous service to all riders. Do not engage in any form of harassment or discriminatory behavior. Treat passengers with respect, and accommodate reasonable requests when possible (such as assisting with luggage or adjusting music/air conditioning), provided those requests do not compromise safety or violate any laws or BCD Motors policies.
- Be punctual and reliable. Make every effort to arrive at pickup locations on time and to transport riders to their destinations in a timely manner. If you encounter an unexpected delay or issue that will affect the pickup or drop-off, promptly communicate this to the rider (through the app or by calling) or to BCD Motors support.
- Use the BCD Motors platform honestly and in good faith. Do not solicit or accept payments for rides outside of the platform, and do not attempt to defraud BCD Motors or riders (for example, by falsifying ride details, accepting ride requests off-app, or deliberately taking inefficient routes without rider consent).
- Comply with any additional driver guidelines, training, or codes of conduct provided by BCD Motors. This may include standards for driver dress code, vehicle signage, handling of lost-and-found items, or other aspects of service quality and safety.
Failure to adhere to the above driver responsibilities and conduct requirements may result in suspension or removal of your access to the BCD Motors platform as a driver. BCD Motors reserves the right to deactivate or terminate a driver’s participation in the Service for any behavior that, in our judgment, violates these Terms or undermines the safety, comfort, or trust of riders or the integrity of our Service.
Limitation of Liability
To the fullest extent permitted by law, BCD Motors (and its affiliated companies, and each of our respective officers, directors, employees, and agents) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of the Service or these Terms. You agree that BCD Motors is a service platform that connects riders with independent third-party drivers, and as such, BCD Motors is not responsible for the conduct, actions, or omissions of any driver or other third party. This means that BCD Motors is not liable for any personal injury, property damage, or other harm that may result from a ride provided by a driver (except to the extent such liability is mandated by law).
BCD Motors provides its Service on an “as is” and “as available” basis, without any express or implied warranties. We make no promise or guarantee that the Service will be uninterrupted, secure, or error-free, or that any particular ride request will be accepted or fulfilled. To the maximum extent allowed by law, we disclaim all warranties, express or implied, relating to the Service, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the quality, suitability, safety, or ability of any drivers or vehicles. You agree that the entire risk arising out of your use of the Service (including the rides you take) remains solely with you, to the maximum extent permitted under applicable law.
If, despite the above provisions, BCD Motors is found to be liable to you for any damage or loss arising out of your use of the Service or these Terms, you agree that the total liability of BCD Motors and its affiliates shall in no case exceed the amount you paid to BCD Motors for the ride or service in question. In cases where the law does not allow the exclusion or limitation of certain damages, the above limitations shall apply to the fullest extent permitted by law. Nothing in these Terms is intended to limit any rights you may have as a consumer under law or any liability that cannot be lawfully limited or excluded.
Dispute Resolution
We are committed to addressing any concerns or disputes you may have in a fair and efficient manner. If you have an issue with the Service or with these Terms, please contact BCD Motors customer support first to attempt to resolve the matter informally. In the event that we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service that is not resolved by mutual agreement shall be subject to the laws and jurisdiction described in the section below. You agree that you will engage in good faith negotiations with us to resolve any dispute before pursuing other remedies.
Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or relating to them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of France, without regard to its conflict of law principles. You agree that any legal action or proceeding arising under these Terms that cannot be settled through the Dispute Resolution process above shall be brought exclusively in the competent courts located in France. By using the Service, you consent to the jurisdiction of such courts and waive any objections to such venue on the grounds of inconvenience or otherwise, to the extent permitted by law.
Modification of Terms
BCD Motors reserves the right to modify, update, or replace these Terms of Service at any time. If we make material changes to the Terms, we will provide you with appropriate notice, which may include notification through the app, website, or via email. The updated Terms will be indicated by an updated “Last Updated” date and will take effect when posted, unless otherwise specified. By continuing to access or use the Service after new Terms take effect, you agree to be bound by the revised Terms. If you do not agree to any updated Terms, you should stop using the Service and, if applicable, cancel your account. It is your responsibility to review these Terms periodically for any changes.
