Privacy Policy
Effective Date: April 5, 2025
Introduction
BCD Motors (“BCD Motors”, “we”, “us”, or “our”) is committed to protecting your privacy. We operate in Dakar, Senegal (with a U.S. mailing address in Wyoming) and provide high-end vehicle rentals and sales, an online catalog and booking platform, and ride-hailing (VTC) services with professional drivers. We also operate a related transport service through our site Traxelio.com. This Privacy Policy describes how we collect, use, share, and protect your personal information when you use our websites (including bcdmotors.com and traxelio.com) and any related services. By using our services, you agree to the collection and use of your information as outlined in this policy.
Information We Collect
We collect various types of information from you when you interact with us, including:
- Personal Information: Contact details such as your name, email address, phone number, and postal address. We may also collect identification details like your driver’s license or passport number (for vehicle rentals or purchases) and date of birth to verify eligibility for certain services.
- Booking and Service Details: Information related to your reservations or service requests. For vehicle rentals, this includes rental dates, vehicle preferences, and any special requests. For ride-hailing services, this includes pick-up and drop-off locations, ride schedules, and details of your trip requests. If you request a quote or contact us, we collect the information you provide in those communications.
- Payment Information: Payment details such as credit card numbers or other payment method information when you make a purchase or booking. These payments may be processed by third-party payment processors; we do not store full credit card details on our own servers except as necessary for processing.
- Location Data: When you use our ride-hailing/VTC services or features (for example, through the Traxelio service or our mobile app), we may collect precise geolocation data with your consent. This helps us connect you with drivers and provide accurate pick-up and drop-off services. You may also provide location information directly (e.g., entering an address for pick-up).
- Website Usage and Cookies: We automatically collect certain information when you visit our websites. This includes your IP address, browser type, device information, pages viewed, and the dates/times of access. We use cookies and similar tracking technologies to remember your preferences, enhance site navigation, and analyze site usage. (See the Cookies and Tracking Technologies section below for more details.)
How We Use Your Information
We use the collected information for various purposes to operate and improve our services, including:
- To process bookings and transactions: We use your information to facilitate vehicle rentals, sales, and ride-hailing reservations. For example, we use personal and payment information to confirm your booking, process payments, and arrange for the vehicle or driver to be available at the requested time and place.
- To provide and improve customer service: Your contact information and booking details are used to communicate with you about your reservations (e.g., booking confirmations, updates, pickup details) and to respond to inquiries, requests for quotes, or any questions you may have. We also use the information to support and assist you whenever you contact us for help.
- To coordinate ride-hailing services: If you use our VTC/ride-hailing services, we use your location and destination information to connect you with an appropriate driver and to navigate the driver to your pick-up and drop-off points. We may share your first name and pickup location with the assigned driver for identification and communication purposes.
- To send updates and marketing communications: We may use your email or phone number to send you information about new vehicles, special offers, promotions, or other news about our services, but only if you have agreed to receive such marketing communications. You can opt out of marketing emails or messages at any time (see "Your Rights" below).
- To personalize and enhance your experience: Information about your preferences and usage of our site helps us tailor our services to your needs. For instance, we may recommend vehicles or services based on your past rentals or show content in your preferred language.
- To improve our services and website: We analyze usage data and feedback to understand how our services are used and to improve the functionality and user experience of our website and applications, fix bugs, and develop new features or services.
- To ensure safety and legal compliance: We may use personal information to verify your identity (for example, ensuring a driver meets age and license requirements for rentals) and to comply with legal obligations. This includes using information for fraud prevention, security purposes, and enforcing our terms and conditions or rental agreements.
- To comply with legal requirements or protect rights: If necessary, we will use your information to comply with applicable laws and regulations (such as record-keeping for tax or insurance purposes) and to protect our rights or the rights of our customers and partners. This could include using data in handling customer disputes, collecting owed fees, or addressing misuse of our services.
Sharing of Information
We understand the importance of keeping your personal information private. We do not sell your personal information to third parties. However, we may share your information in the following circumstances:
- With our service providers: We share information with trusted third-party providers who perform services on our behalf. This includes payment processing companies, website hosting and analytics providers, customer relationship management tools, email/SMS delivery services, and IT support. These third parties are only given the information necessary to perform their functions and are contractually obligated to protect your data and use it only for the purposes we specify.
- With drivers and transportation partners: If you use our ride-hailing or chauffeur services, we share relevant details with the driver assigned to your ride. This can include your first name, pickup and drop-off location, and any special instructions necessary to complete the service. For vehicle rentals or deliveries, we may share information with our staff or contracted partners responsible for handover of the vehicle.
- Within our company and affiliates: We may share information between BCD Motors and our affiliated services (such as Traxelio) to streamline our operations and provide integrated services to you. For example, data from a booking made through Traxelio.com may be shared with BCD Motors’ systems and staff if needed to fulfill the request, since Traxelio is part of our transportation service offerings.
- With business partners (for requested services): If a service you request involves a third-party partner (for example, if we arrange a service through another transport provider or a hotel as part of a package), we will share the minimum necessary information with that partner to fulfill your request. Such partners are expected to protect your information and use it only for the relevant purpose.
- For legal reasons: We may disclose your information if required to do so by law or legal process, or if we have a good-faith belief that such action is necessary to (i) comply with a legal obligation (for example, responding to lawful requests or court orders), (ii) protect and defend our rights or property, (iii) prevent fraud or abuse of our services, (iv) protect the safety of our customers or the public, or (v) enforce our terms and agreements.
- In business transfers: In the event that BCD Motors or its related businesses (including Traxelio) undergo a business transaction such as a merger, acquisition, reorganization, or sale of assets, your personal information may be transferred as part of that deal. We will ensure any such transfer is subject to the same protections described in this policy, and we will notify you (for example, via email or a notice on our site) of any change in data ownership or uses if required by law.
Data Security
We take reasonable measures to protect your personal information from unauthorized access, loss, or misuse. Our websites use encryption (such as SSL/TLS) to protect data transmission, especially for sensitive information like payment details. We store data on secure servers and employ administrative, technical, and physical safeguards to secure the information we manage. We also restrict access to personal data to authorized employees or contractors who need it to perform their job duties. While we strive to use commercially acceptable means to protect your personal information, please be aware that no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee absolute security of your data, but we continuously update and monitor our security practices to mitigate risks.
Data Retention
We retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy and to comply with applicable laws. This means we will keep your data for as long as you maintain an account with us or as needed to provide you with services (such as maintaining records of your rentals, sales, or ride history). We may also retain certain information after you close your account or cease using our services, if retention is reasonably necessary to comply with legal obligations, resolve disputes, enforce our agreements, or as otherwise required or permitted by law. When your personal information is no longer needed for these purposes, we will securely erase it or anonymize it.
Your Rights and Choices
You have certain rights regarding the personal information we hold about you. These rights may vary depending on your location and the applicable privacy laws, but we will honor the rights applicable to you. Your rights include:
- Access and Portability: You have the right to request a copy of the personal information we have about you, and to obtain it in a commonly used electronic format. This helps you to review the information and, if you wish, transfer it to another service provider.
- Correction: If any of your information is inaccurate or incomplete, you have the right to request that we correct or update it. You can also update certain information by logging into your account on our website (if you have one) or by contacting us directly.
- Deletion: You can request that we delete your personal information. Upon request, we will remove or anonymize the information we hold about you, unless we are required to keep it for legal reasons (for example, certain transaction records must be retained for financial reporting or legal compliance).
- Withdrawal of Consent: If we are processing your personal information based on your consent (for example, for marketing communications or collecting precise location data for the app), you have the right to withdraw your consent at any time. This will not affect the lawfulness of any processing that was done before you withdrew consent, and it may mean that we can no longer provide you certain services that rely on that consent.
- Objection to Processing: You have the right to object to certain types of processing, such as direct marketing or when we process your data based on legitimate interests. If you object, we will reconsider our processing activities. We will comply with your objection unless we have compelling legitimate grounds to continue or if the data is needed for legal reasons.
- Opt-Out of Marketing: You can opt out of receiving promotional emails or SMS from us at any time. To do so, click the "unsubscribe" link in any marketing email, reply "STOP" to an SMS, or contact us using the information below. Please note that even if you opt out of marketing messages, we may still send you transactional or service-related communications (such as booking confirmations or notifications about your service usage).
To exercise any of these rights, please contact us using the contact information provided in the "Contact Us" section below. For security, we may need to verify your identity before fulfilling certain requests. We will respond to your requests within a reasonable timeframe and in accordance with applicable law.
Cookies and Tracking Technologies
We use cookies and similar tracking technologies on our websites to provide a better user experience, for performance and analytics, and for advertising or marketing purposes. Cookies are small text files that are stored on your device by your web browser. We may use different types of cookies, including:
- Essential Cookies: These cookies are necessary for our website to function properly. They enable core features such as security, network management, and accessibility. For example, they may keep you logged in during your session or remember your rental cart selections.
- Preference Cookies: These cookies allow our site to remember choices you make (such as your preferred language or region) and provide enhanced, more personalized features.
- Analytics Cookies: We use these to collect information about how visitors use our site, which pages are popular, or if any errors occur. This data helps us improve the website’s performance and your experience. For instance, we might use Google Analytics or similar tools that use cookies to gather usage data (in an anonymized form).
- Advertising Cookies: If we ever display advertisements or use third-party advertising networks, these cookies would be used to deliver relevant ads to you and to measure the effectiveness of ad campaigns. (As of the effective date of this policy, we primarily use your data for our own marketing and do not host third-party ads on our site.)
- Social Media and Third-Party Cookies: Our website may integrate with social media platforms (such as Facebook, Twitter, or Instagram, for example, through share buttons or feeds). These services may set cookies that can collect your IP address and which page you are visiting on our site. These cookies are controlled by the third parties and are governed by their privacy policies.
You have choices regarding cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. You can also clear cookies from your browser at any time. Please note that if you disable or delete cookies, some features of our website (such as retaining your login or remembering your preferences) may not function properly. We currently do not respond to "Do Not Track" signals, as there is no consistent industry standard for compliance, but if one is established we will revisit our policy.
International Data Transfers
BCD Motors is based in Senegal, and we also maintain a business presence in the United States. When you use our services or provide information to us, your personal data may be transferred to, stored in, or processed in Senegal, the United States, or other countries where our service providers are located. These countries may have data protection laws that are different from the laws of your country of residence. For example, personal information collected in your home country may be transferred to or accessed by our team in Senegal for service fulfillment, or stored on servers in the United States for processing and backup.
We take steps to ensure that international transfers of personal data are protected in accordance with applicable law. If you are located in a region with data transfer regulations (such as the European Economic Area), we will implement appropriate safeguards for your data transferred outside of that region. This may include using standard contractual data protection clauses approved by relevant regulators, or relying on your consent where permitted, or other legal mechanisms. By using our services and providing us with your information, you consent to the transfer of your information to our facilities and those third parties with whom we share it as described in this policy, even if they are located in different countries.
Links to Third-Party Sites
Our website and apps may contain links to websites or services that are not operated by us, such as partner websites or social media platforms. If you click on a third-party link, you will be directed to that third party’s site. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. We encourage you to review the privacy policy of every site you visit. This Privacy Policy applies solely to information collected by BCD Motors and our affiliated services.
Children’s Privacy
Our services are not directed to children under the age of 18, and we do not knowingly collect personal information from anyone under 18 years old. If you are under 18, please do not use our services or provide any information to us. If we learn that we have inadvertently collected personal data from a minor without appropriate consent, we will take steps to delete that information. If you are a parent or guardian and you believe that your child under 18 has provided us with personal information, please contact us so that we can remove the data.
Changes to This Privacy Policy
We may update or revise this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. If we make material changes to this policy, we will notify you by prominently posting a notice on our website or through other appropriate communication channels prior to the change becoming effective. The "Effective Date" at the top of this policy will be updated accordingly. We encourage you to review this page periodically to stay informed about how we are protecting your information.
